Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Quiet Care website and service operated by Quiet Care (“Quiet Care,” “we,” “us,” or “our”). By reserving a spot, becoming a member, or otherwise using our website or service, you agree to these Terms. Please read them carefully.
1. The Service
Quiet Care provides in-home, camera-free ambient monitoring and check-ins intended to help older adults live independently while giving their families peace of mind. Our sensors learn a household’s daily routine and we reach out when meaningful changes occur. We may modify, suspend, or discontinue any part of the service at any time.
2. Not a Medical or Emergency Service
Quiet Care is a wellness and peace-of-mind service. It is not a medical device, is not intended to diagnose, treat, or prevent any medical condition, and is not a substitute for emergency services such as 911. Quiet Care should never be relied upon as the only safety net for the person being monitored. In an emergency, always call 911 or your local emergency number.
3. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the service. If you are arranging the service for another person, you represent that you have the authority to do so on their behalf.
4. Consent of the Monitored Person
You represent that the person whose home and daily patterns will be monitored is aware of and consents to the service, or that you have the legal authority to provide that consent on their behalf. Respecting the dignity and consent of the people we serve is fundamental to how Quiet Care operates.
5. Reservations, Deposits, and Membership
- Reserving a founding spot requires a fully refundable deposit of $25, which is credited toward your first month of membership.
- Founding members lock in a rate of $79 per month for life, which is below our expected $129 per month public rate.
- Membership is an ongoing monthly subscription that begins when we install the service in your home.
- You may cancel your reservation at any time before installation for a full refund of your deposit.
- Payments are processed by our third-party payment provider, Stripe, and are subject to their terms.
6. Acceptable Use
You agree not to:
- Use the website or service for any unlawful or unauthorized purpose.
- Interfere with, disrupt, or attempt to gain unauthorized access to our systems or networks.
- Reverse engineer, copy, or resell any part of the service.
- Use the service in any way that could harm Quiet Care, our members, or the people we monitor.
7. Termination
You may cancel your reservation or membership at any time, subject to the deposit and refund terms above. We may suspend or terminate your access to the service if you violate these Terms or if we discontinue the service.
8. Intellectual Property
The website, service, and all related content, software, and branding are owned by Quiet Care and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the service.
9. Disclaimers
The website and service are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or that it will detect every change or event in the home.
10. Limitation of Liability
To the fullest extent permitted by law, Quiet Care will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the service. Our total liability for any claim relating to the service will not exceed the amount you paid to us in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Quiet Care from any claims, damages, or expenses arising out of your use of the service, your content, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in King County, Washington.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the website or service after an update means you accept the revised Terms.
